Here’s what you need to know about setting up a Lease Agreement in Queensland (QLD)

In Queensland, landlords or property owners are required to use a legal document known as the General Tenancy Agreement (Form 18a). This document outlines the legal rights and responsibilities of both the tenant and property manager/owner. It is important to have a written lease agreement regardless of whether or not the person renting is family or a friend, as it protects both parties. 

A tenancy or lease agreement must include:

  • the name and address of the tenant and property manager/owner
  • the start and end date of the agreement (or state that it is periodic)
  • how the tenant should pay rent and how much is to be paid
  • contact details for nominated repairers
  • standard terms (what the tenant and the property manager/owner can and cannot do)
  • any special terms (these should be agreed upon in advance)

Signing a lease agreement

You must provide the lease agreement to your tenant or before the day of occupancy under the agreement. The tenant must then sign the document and return it within seven days. 

You should also send a copy to the tenant within 14 days of receiving the original document.

Why do I need a Lease Agreement?

You need a written lease agreement to avoid potential disputes that could arise between you and your tenant. Without such an agreement, there is no clear understanding of who is responsible for what regarding repairs, rent payments, pet rules and other important issues.

A written lease helps ensure that both parties are on the same page and have a legal document to refer to if any conflicts arise.
