Tenant Checks in SA

Find out everything you need to know about conducting a Tenant Check in SA.

Here’s what you need to know about tenancy checks in SA before leasing out your property.

In South Australia, tenant checks are regulated by the Residential Tenancies Act 1995 (SA), which sets out obligations for residential tenancy database holders and users.

These regulations ensure that the information held on these databases is accurate and complete. This information can have serious implications when deciding if a person is suitable for rental accommodation, so it is essential to maintain accuracy and detail in such databases.

Under the Residential Tenancies Act 1995 (SA), residential tenancy databases are required to be updated regularly and notify potential tenants of their right to view the data on them. They must also provide a dispute resolution process where a tenant feels that any information contained within the database is incorrect or incomplete.

The legislation also requires owners of residential tenancy databases to take reasonable steps to ensure that all information they hold is secure from unauthorised access or use. This includes taking measures to protect personal details such as names, addresses, dates of birth and other sensitive information from being misused or accessed without consent.

Similarly, interstate operators must comply with these requirements or face prosecution for breach under s 99C of the Residential Tenancies Act 1995 (SA).

Limitations of listings

Information can only be listed in a tenancy database if:

  • a residential tenancy agreement has ended; AND
  • the tenant breached the agreement; AND
  • where the breach results in the person owing the landlord an amount that is more than the bond; OR the Tribunal has made an order terminating the residential tenancy agreement, OR the Tribunal has not made an order under section 89A(4)(d) prohibiting the listing (see below Terminations based on domestic violence).

The personal information recorded must relate only to the breach and be accurate, complete and unambiguous.
