Digital Delivery

After ordering online, you will receive an email confirmation from RentBetter or from Stripe containing your order details (if you have provided your email address correctly).

We will normally confirm receipt of your order within a few minutes of ordering, and then confirmation of your ad being published typically takes 2-4 hours from the time of completion and payment. From time to time the property sites may have delays or verification may require follow-up and therefore it may take longer than 2-4 hours to publish your ads.

Refund & Returns Policy

If for any reason you are not completely satisfied with your purchase we will give you a 3 day money-back guarantee from the time you post your ad.

Please email us at info@rentbetter.com.au within that time if you are not satisfied with your purchase so that we can resolve any problems.

This refund policy does not apply to ads which have been published and reviewed as expected, received enquiries and applications, or for which a tenant has been signed even if the tenant was secured using another service or agent.

Where a customer has paid for an ad or access to the platform and not responded to verification requests in a timely manner, or not cancelled their subscription prior to a charge, a refund will not be offered. Where a purchase has been made and a refund has been requested after the purchase, a $30 processing fee will be charged.  

RentBetter Terms of Use Introduction

Please read these Terms carefully. By signing up for an account and using the RentBetter platform, you agree to the following Terms. This is a legal agreement.

When you sign up for an account and complete your payment, you are deemed to be a RentBetter user / customer and have given RentBetter Listing Authority. The price charged is listed on the home page, as well as on the ‘checkout’ page of the website which include Goods and Services Tax (GST).

The RentBetter Platform is an online tool that enables registered users / customers to use the tool to help them manage their rental property.

As the provider of the Platform, RentBetter provides the necessary tools for users / customers to advertise and manage their property, but RentBetter does not manage the property or act as an agent for a user / customer.

The user / customer is responsible for their advertising and managing their property. When users / customers send property enquiries, make or accept an application to rent a property, they are entering into a contract directly with each other.

RentBetter is not and does not become a party to or other participant in any contractual relationship between users / customers and their tenants via a lease agreement, nor is RentBetter a real estate agent within the agreement between the user / customer and tenant.

Sign up for an Account

To become a RentBetter customer and use the RentBetter platform for the rent or sale of residential or commercial property you must: be the owner of the property who is legally entitled to do so be at least eighteen (18) years of age be authorised by the owner of the property sign up, agree to these terms and conditions and provide accurate up to date contact information.

By using the RentBetter platform you must agree and meet the requirements listed above and not violate any laws or regulations. RentBetter may change requirements at any time.

The Term

There is no minimum term to use RentBetter, when you sign up to use the RentBetter platform, that is when the term begins.

The term continues for as long as you use the platform (terminate your account).

By clicking the ‘Get Started’ button after entering your user details when signing up, and ticking the box to agree with the terms and conditions, means you have officially ‘signed’ and agree to these terms.

If you sign up for RentBetter on behalf of a company or other entity, you represent and warrant that you have the authority to accept these Terms on their behalf.

Termination

You or RentBetter may choose to terminate your account. RentBetter may terminate or suspend your account at any time, with or without written notice, to use or access any part of RentBetter.

In the event that a property or ad lies dormant for an unexpected period of time, there are complaints from prospective tenants about the behaviour of a customer, or a property appears to have been rented without the ad being removed (e.g. there are an excessive number of enquiries for a property over a long period of time) then the customer will be deemed to be operating outside the RentBetter terms of service and the ad or property will be removed.

Cancellation

Annual or monthly plans provide access to the RentBetter rental platform features.

If you would like to cancel your subscription before it auto renews, you can visit your account section on the platform to cancel your ongoing subscription.

Property Advertisement

You may sign up to the platform to post your property advertisement to third party property portals until leased or sold, at the price posted on the pricing page of our website which may change from time to time and which includes ‘Goods and Services Tax’ (GST).

You agree to give RentBetter the authority to advertise your property for rent or sale on your behalf to the nominated third party property portals.

RentBetter does not act on behalf of you in relation to the lease or sale of your property, but assists you to advertise. Until leased or sold means you can have your property advertisement posted on the third party property portals until you find tenants or a buyer.

RentBetter Team will work closely with you to ensure that your ads are removed in a timely manner once a tenant or buyer has been secured. You agree to notify RentBetter once your property has been leased or sold. Where the pattern of behaviour for a user or the status of a property is outside the expected behaviour, ads or properties may be removed from the property sites.

Publishing Property Advertisement

All property advertisements submitted to be published to our site or any third party property portal will be approved by our team before being published as a standard listing.

If the property advertisement does not abide by these terms we will disapprove the property advertisement and your advertisement will not be published.

You will be notified to make necessary changes before the property advertisement is published. If you fail to make the necessary changes your account may be suspended or terminated.

You will also be notified if your ads have been running for an extended period of time and confirmation of the ad status will be requested. Typically after within 12 months an ad will be reviewed and further charges may apply, after 12 months the ad may expire and be removed from the property sites.

Every effort is made to publish property advertisement to third party property portals within four business hours, however property advertisements may be published beyond the four hour period depending on the time taken to process your advertisement when submitted to third party property portals, system outages, technical issues, security involved, or for the interest of customer service.

Property advertisements may be displayed on the third party property portals earlier depending on the processing times.

Property Management Platform

If you choose to use the RentBetter Platform, you act exclusively on your own behalf and for your own benefit, and not on behalf, or for the benefit, of RentBetter.

The user / customer acknowledges and agrees that RentBetter is providing a tool for self-management of the user / customer’s property and RentBetter is not in any manner whatsoever managing the property and is not and will not be engaged as the property agent or a resident letting agent.

RentBetter uses Stripe, Zepto and Ezidebit to facilitate the payment process for all payment transactions (including rent payments) through the RentBetter site.

As a business, RentBetter does not store any payment details that you enter on our site, they are tokenised and securely held by our payment providers. You hold responsibility to agree to any terms and conditions of Stripe, Zepto or Ezidebit when making a payment.

When you create a lease, your tenant will be invited to sign-up and onboard to that lease and the rental payment schedule. A Tenant has the option to pay recurring rental payments via credit card or direct debit.

RentBetter will initiate the payments three days prior to the due date according to the details used to set-up the lease on the RentBetter site.

RentBetter does not operate a trust account. Rent payments are transferred to the user / customer after they have become cleared funds.

RentBetter does not take service fee from the rental payments. Instead a separate monthly fee is charged to the user / customer as part of initial lease set-up process.

If a Tenant rental payment fails, RentBetter will assist by sending notifications of the failed payment and reminders of the actions required to complete the payment.

RentBetter may help the user / customer prepare notices to deliver to the Tenant.

All users / customers of RentBetter agree to:
- Receive notices from users / customers to your email address.
- Provide direct debit authority to pay your rent via credit card or direct debit.
- Complete payments via the RentBetter platform except for where an agreement to pay outside the platform has been reached.
- Calculate rental payments on a weekly basis, where rent is paid on either a weekly, fortnightly or monthly basis.

RentBetter Rights, Rules and Authority to Act Rights

You shall respect our proprietary rights in the Websites and the software used to provide the capability of the platform (proprietary rights include patents, trademarks, service marks, and copyrights).

You may not copy, modify, distribute, sell, or lease any part of our platform capability or included software, nor may you reverse engineer or attempt to extract the source code of that software, unless laws prohibit those restrictions or you have our written permission.

Rules

If you violate any of these rules then we may suspend or terminate your account.

Compliance with Residential Tenancy Act: When using RentBetter to rent your residential rental property we expect you to abide by the Residential Tenancy Act or Regulations applicable to the State or Territory where your rental property is located.

If we have reason to suspect that you are not abiding by these laws we may suspend or terminate your account.

Compliance with Selling of Residential Property in your state:

When using RentBetter to advertise your property we expect you to abide by the laws governing the sale or rental of residential property in the state your property is located.

If we have reason to suspect that you are not abiding by these laws we may suspend or terminate your account. Information on our platform or provided by our Team should not be regarded as a substitute for professional legal, financial, commercial or professional advice of any kind. You should seek independent legal advice.

No warranty is made as to the accuracy of information provided by the RentBetter Team. Whilst we make every reasonable endeavour to achieve accuracy and reliability in the information provided on the website and in associated publications including resource documents.

Authority to Act

The RentBetter Terms of Use, our Privacy Policy, Acceptable Use Policy (all of which are incorporated into these Terms by reference), and any Additional Terms you’ve agreed to make up the entire agreement and supersede all prior agreements, representations, and understandings and provide authority to undertake the actions necessary to provide the relevant capability of the platform related to your property e.g. advertising a property, obtaining references, entering into and signing tenancy agreements, collecting rental payments, receiving and disbursing rental bond money.

RentBetter Acceptable Use Policy

The actions users take can have an impact on our platform and other users of the platform. Users must follow this Acceptable Use Policy, if you violate it we may suspend or terminate your account.

- Advertising anything other than a Property for Rent or Sale.
- Incorrect Descriptions of a Property Advertisement
- Incorrect or Misuse of Photos for Property Advertisements
- Displaying a photo, drawing or other image that is not a photograph, drawing or image of the property being offered for rent.
- Giving a False Address of the Property
- Upload, Post, Transmit Unacceptable Material
- Continue to advertise if you are not currently seeking a tenant or a buyer
- Communication that is not acceptable or deemed inappropriate

RentBetter Fair Use Policy

Use of the RentBetter platform to find a tenant and manage a property is governed by a fair use policy, and what is deemed to be reasonable.

In the event that an account has not been accessed for a considerable period of time, the account will be reviewed by the RentBetter Team and may be removed from the site.  

Liability

You acknowledge and agree that, to the maximum extent permitted by law, the entire risk arising out of access to and use of the RentBetter platform, remains with you.

You agree to release RentBetter officers, directors, and employees harmless from and against any claims or liabilities arising from use of RentBetter.

ConnectID and Digital Identity Data

1. We are a participant in a digital identity network, ConnectID, that enables you to request various organisations with whom you have a relationship (Identity Providers) to provide identity and attribute information (together Identity Data)about you to us. This can help streamline our interactions with you. Identity Data may include identity and attribute information such as your name, telephone number, email, date of birth and address

2. The “ConnectID Network” facilitates the transfer of Identity Data on a bilateral basis between us and the Identity Provider (each a Digital Identity Transaction). However, the ConnectID Operator does not access or hold your Identity Data and the transfer of Identity Data occurs directly from the relevant Identity Provider to us.

3. Any Digital Identity Transaction is at your request and option, and any Identity Data will only be provided by the Identity Provider selected by you and with your express consent. If you do not provide your consent, the Digital Identity Transaction will not be performed and we will provide you with an alternative option to provide your Identity Data or have your identity verified, other than through ConnectID.

4. Each Digital Identity Transaction is a one-off transfer of Identity Data, and any further transfers of Identity Data, including any transactions where you ask the same Identity Provider to provide us your Identity Data, will require further consent from you and a new Digital Identity Transaction.

You acknowledge that where you consent to the transfer of Identity Data to us from an Identity Provider:

- we may collect, use and disclose the Identity Data as consented to by you as part of the Digital Identity Transaction, and for secondary purposes where you have further consented to such secondary purposes or where the secondary purposes are otherwise permitted by applicable privacy law, our terms with you and our Privacy Policy
-the Identity Provider will no longer control and will not be responsible for the security or handling of any Identity Data that has been transferred by the relevant Identity Provider to us, and our terms with you and our Privacy Policy will govern our handling of Identity Data, not the terms you have with the Identity Provider nor the Identity Provider’s Privacy Policy
-if we suffer a security or data incident that impacts your Identity Data, you consent to us providing to the Identity Provider information about such incident, including your Personal Information and the Identity Data impacted by the incident, which the Identity Provider may use to seek to prevent or respond to cyber security incidents, fraud, scam activity or identify theft;
-neither us nor the ConnectID Operator endorse or make any representations or recommendations in respect of any Identity Providers, including in respect of the suitability of their security or privacy practice
-both us and the ConnectID Operator exclude all liability to you to the maximum extent permitted by law in connection with any acts or omissions of the Identity Provider
-The exclusions in this section that relate to the ConnectID Operator are held on trust by us for the ConnectID Operator. This means that, although the ConnectID Operator is not a party to these terms, it can rely on your acknowledgment of and agreement to these exclusions
